Illegal entry also carries consequences for anyone who might later attempt to apply for a green card or other immigration benefit.

When it comes to the notice of the prosecutor that the suspect has committed an immigration offence whilst in a coerced situation and may be a victim of human trafficking, prosecutors are advised to make further enquiries of the investigating officer and or the UK Human Trafficking Centre and consider the public interest factors when considering whether to proceed with a prosecution. If it is against the law then you should go to jail. Some immigrates would prefer US jail over going back to their country. That is really sad.

This is a typical series of events when an illegal immigrant is arrested: The illegal immigrant will be held in the jail of the city, county, or parish in which they were charged; the jail will report the illegal immigrant to ICE. ICE will indicate to the jail and the D.A. that they want the D.A. to drop the charges. The D.A. usually drops their charges. ICE officers come to the jail. They take the illegal immigrant into federal custody. They place him or her in a federal detention center. And ICE then transports the illegal immigrant to immigration court.

If you're in the country but are not a U.S. citizen, a criminal conviction may result in your deportation or removal from the United States. That is, the federal government can send you back to your native country and bar you from reentering for a number of years.

The hold notifies the facility to not release the person, but instead to transfer him or her to federal custody at the end of the jail term. An immigration hold may be placed after either a random check by ICE officers (who sometimes visit jails and interview inmates_ or after being notified by the law enforcement agency detaining the person. When DHS places a hold, state law enforcement agencies are obligated to comply.

In cases where there is a joint investigation with the Police and UKBA, the police will normally lead the investigation. Meetings at an early stage of the investigation or case preparation are recommended to outline steps that should be taken to agree case progression. There may also be a need to agree joint/shared disclosure arrangements.
